Product: “Builder Whirlpools” Acrylic Whirlpool Bathtubs (Product/Unit).
Warrantee: Original Factory Direct Purchaser (Customer).
Warrantor: Builder Whirlpools, a division of Bath-Tec, Inc.
Warranty Starts: Original Purchase Date (Manufacturers Invoice Date).
Warranty Coverage Period: One (1) Year.

Terms:The warranty covers the acrylic bathtub, pump/motor, jet system, and factory installed options and is limited to defects in material and workmanship. The Manufacturer will supply replacement parts, repair, replace or issue credit for (at the Manufacturers option) any new unit or component originallypurchased direct from the factory which proves to be defective in material and/or workmanship within the stated warranty coverage period.
Exclusions:
Excluded from this warranty are certain damages including but not limited to
the following: shipping damage; installation damage; improper care and cleaning;
damage due to product modifications or additions not performed by the Manufacturer;
damage relating to commercial use or any use other than personal, family or
residential purposes; damage due to the use of chemicals, bath oil additives
or improper cleaning agents; incidental or consequential damages related to
a defective unit (e.g. water damage to carpet, floor or ceiling; loss of use,
etc.). This warranty does not cover minor blemishes, pitting or crazing or
costs incurred in the removal, installation or transportation of a unit. This
warranty does not cover any dealer or installer modifications or defects that
should have been discovered before installation. This warranty does not apply
if the unit has been subjected to after-market modifications or the unit is
moved from its place of initial installation or is not installed in accordance
with the instructions supplied by the Manufacturer. This warranty is void outside
the continental United States.
Responsible Parties:
Damage occurring in transit is the responsibility of the carrier (trucking company).
The Customer must open the crate and inspect the unit (in the presence of the
carrier) for damages when delivered. If damage is discovered it must be reported
to the carrier and the Manufacturer immediately.
Inspecting the unit prior to installation is the responsibility of the Customer. The Customer is responsible for ensuring the unit is free of defect or damage upon delivery and prior to installation. In the event of a problem, the unit must not be installed. The Manufacturer is not responsible for failures or damage that could have been discovered, repaired or avoided by proper inspection prior to installation.
It is the responsibility of the Customer to provide adequate access for service under the unit. The Manufacturer is not responsible for any costs relating to obtaining access for repair.The Customer is responsible for knowing local code requirements. The Manufacturer is not responsible for costs to modify any unit to obtain any code approval, such as city, county or state building codes.
Conclusion:
No one is authorized to make any warranties on the Manufacturers behalf. The
warranty card should be completed immediately and returned to the Manufacturer
with a copy to be retained by the Customer for presentation in the event of
warranty failure.
This warranty provides you with specific legal rights and you may have rights which vary from state to state. The Manufacturer urges prospective consumers to read this warranty carefully to fully understand its benefits and limitations as well as the Customers obligations and the obligations of others.
All dimensions are based on Manufacturers mold tolerances of 3/8”. The Manufacturer does not guarantee the availability of all products, features, colors, and accessories displayed in the printed brochure or the electronic brochure. The Manufacturer, in a continuing effort towards product improvement, reserves the right to discontinue any model, alter designs and specifications without notice, liability, or obligation.
